This Privacy Policy ("Policy") supplements the General Terms of Use, the Film Terms of Use and the Music Terms of Use between Underground Icewhole Limited ("Us"/"Our" and/or "We"), a company registered in England and you ("You"/"Your" and/or the "Film and Music Provider"). Our registered office is at 10 Orange Street, Haymarket, London WC2H 7DQ. For the purposes of this Privacy Policy, Underground Icewhole Limited shall include its group and associated companies, namely Underground Holdings Limited, Underground Music Limited, Underground Movies Limited and Underground X Limited.

This Policy supplements the General Terms of Use, Film Terms of Use and the Music Terms of Use (jointly and severally referred to as the "Terms"), forms part of the Terms and should be read in conjunction with them. You can view them here. Expressions used in the Terms have the same meaning in this Policy.

Our Website and the services We provide to you enable You together with other users of Our Website to view each others' Film(s), listen to each others Music and/or profiles, communicate with other users of the Website, share submissions, post messages and chat to each other and describe Your profile and discover their interests and in order to achieve this We collect and make available certain personal information about you. You should note however that any user submissions that You submit to Us that do not identify You personally and that We publish on the Website will become available to all users as published content and are not subject to this Policy as they are not personally identifiable information.

In this Policy we aim to inform Our users of Our policy regarding the use and disclosure of personal data We collect via the Website so to ensure You are happy with that use and choose to continue using the Website. We recommend You read it carefully and send any questions You may have about it and the measures We take to safeguard your privacy online to privacy@icewhole.com. We will use any personal information collected via the Website in accordance with the Data Protection Act 1998 (the "Act") (and other regulations) as applicable. What personal information do We collect?  

We collect personally identifiable information from all Our users to enable Our users to make proper use of the Website and Our services, such as Your name, email address, age, photo identity, gender, education, occupation and personal interests.

We also use software that collects general information about use of the Website and which is not personally identifiable user information in order to manage and improve the Website services and to monitor usage. Such information may include profile information, referring/ exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of requests and cookies that may uniquely identify your browser and browser type. User IP (Internet Protocol) addresses will also be logged for security and tracking purposes.

We may use all these types of information by storing, monitoring and analysing trends and preferences in usage to improve the quality of service, functionality and design of the Website and services and to develop new features and promotions We think may be of interest to users.

Users' who become members and give Us their personal details will have their full names made available directly to other members as well as a user's chosen online name, his/her pictures and video clips are displayed by Us in the context of the Website and the services operated from it.

We allow users to search for other members using first and last name, email address, and schools and/or companies where users may have attended or worked

Submissions and personal information that You voluntarily disclose anywhere on the Website, whether within your personal profile or on a message board, will be accessible to the public and other Users may collect and use such information. Your email address will not be revealed to other Users, although your account name will be displayed when you send messages, comments or upload videos through the Website. Any Submissions may be viewed by any visitor and redistributed through any media as well as the Internet.

You have a right to request a copy of the personal information We hold about you and to have any inaccuracies corrected. We charge £10.00 for information requests. Please address requests to Us by email at privacy@icewhole.com


How We use Your personally identifiable information  

We may use a user's email address to send newsletters, news, updates and for other non-commercial administrative purposes. Members may choose not to receive such correspondence by changing their "notification" setting to "Do not send me notification emails" in the user "Account Settings".

We may sponsor a contest or promotion on the Website. To participate users may be requested to provide personal information including name, email address or home address. If users have explicitly requested to receive information from certain advertising partners, we may transfer Your personal details to them. It will be clearly evident as to who is collecting the information and whose privacy policy applies, at the point of collection.

We will not use Your personally identifiable information for marketing or commercial purposes without Your prior consent, or an option to opt-out, if part of a specific feature.

Our Website's users can invite friends to join by sending invitation emails via our automated invitation system. The system stores the email addresses that users provide so that the respondents may be added to the friend's list of the user sending the invitations, and also to send reminders of the invitations. We do not pass on or sell these email addresses to others or use them to send any other communication besides invitations and invitation reminders. If you receive an invitation from Us you can request We remove your information from Our database.

Users can also store their contacts email addresses in their internal address book and send invitations and other communications to those addresses.

You may prevent email invitations and other messages from being sent to any email address you control by sending a single email with the subject "BLOCK" to privacy@icewhole.com. Please note that the email must come from the account you wish to block.


Use of Cookies and clear GIF's  

When you visit Our Website, You will be sent one or more cookies, a small text file containing a string of alphanumeric characters, for storage on Your computer and which uniquely identifies Your browser. When and to whom We disclose Your information

Third Party Advertising / Links

Security  

We provide users with the option of not providing personally identifiable information about themselves whilst using the Website services - but this may restrict your ability to fully use all the available services. Users may update personal details at any time by logging on here www.icewhole.com.

To preserve the integrity and security of Your personal information You will have to create Your unique password which is required to enable You to access any personal profile. We use reasonable technical measures to protect stored member information but We cannot ensure and do not guarantee the security of account information that You transmit to Us, and you transmit this information at Your own risk. You must keep your unique password and username confidential to you and not disclose it to anyone else - users remain at all times solely responsible for passwords and usernames and must maintain their secrecy. We restrict access to member information by our personnel to those employees who need access to the information to carry out their roles in Our company such as customer service personnel and technical staff.

In the event of a security system breach, any unauthorised entry or use, applicable hardware or software failure or any other factors which may have affected the security of member information users may be electronically notified so that any necessary protective steps may be taken. We will in such circumstances post an appropriate notice on the Website.

Members may also 'opt out' of receiving new, updates and other notifications by selecting "Do not send me notification emails" in the user profile "Account Settings". Users who do not wish to receive Our newsletters may choose not to by selecting "Do not send me newsletters" in the user profile "Account Settings".


Changes and Modifications to this Policy  

We reserve the right to update this Policy from time to time and any changes will be indicated to apply as from the "Change Date" set out below.

If We do make changes to this Policy, We will post them on the Website to notify users. Users continued use of the Website and the services made available from it constitutes individual agreement to the terms of this Policy and revisions to it.

We will post appropriate notices for at least 30 days on the Website where a material change in the use to which we put users personally identifiable information is made from that stated at the time We originally collected the information.


Children's Privacy  

We prohibit persons less than 14 years of age (without parental consent) using this Website at any time or in any manner and no part of Website is directed to persons under 14. We do not knowingly collect or maintain personally identifiable information or non-personally-identifiable information from persons under 14 years old. If it comes to Our attention that such information has been collected through the Website services We will take appropriate steps to delete such information.


International Users  

The Website is hosted in and intended for users in England and all terms of use governed by English law, the Terms and this Policy through Your continued use of the Website You are transferring Your personal information to England and You consent to that transfer, whether accessing the website from England or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from English law and regulation.
